Divorce does not have to be a lengthy process. If the relationship is an unhealthy one, you should not allow yourself to stay any longer than you have to. When both spouses have reached a mutual decision about getting a divorce and have agreed on its terms and conditions, there are some things that can be done to help expedite the divorce process.
Be in agreement with your spouse about the terms of the divorce. When there is no litigation about marital assets and child custody, quick divorces are usually granted. Mutually decide ahead of time who should get a particular property and write it down. For example, if you own a house, you should decide who will live in it. You also have the option to sell it and divide the earnings between the two of you before you go to court. This will be helpful to lessen the issues you have to worry about.
You should clearly outline the details surrounding visitations if you have children such as who should maintain custody of the children and other important conditions. It will make the divorce more smooth sailing if both parties are in agreement about this matter. Primarily, judges give the custody of children to their mothers. However, the security and stability of the children still remain the major considerations in any divorce proceedings. In other states, both parties are required to attend a divorce class to help their children deal with the situation.
It is also necessary to prepare all the important paperwork such as financial statements, proof of income and your written and notarized mutual statements. If you present your documents in a complete, organized and well-detailed manner, there is no reason to further delay the divorce process because everything is clearly laid out.
If your spouse wants to contest the divorce, you should separate with him or her as soon as possible. A quick divorce can be granted if you and your spouse have been living separately for a year whereas a contested divorce can take several years.
File for a no-fault divorce because it does not require compelling reasons to get a quick divorce. A no-fault divorce frees both parties of any responsibility for the end of the marriage.
Get a quick divorce in other cities or states that grant faster divorces than the area you are located at. For instance, residents of Nevada can get a quick divorce in Reno.
You can also seek a divorce in another country such as the Dominican Republic which grants quick divorces to foreigners. However, in order to make it legal, both spouses have to agree on foreign divorces and the distribution of their properties as well.
Getting a quick divorce greatly depends on the agreement of both parties. Keep in mind that if you do not want to be hassled by the long divorce proceedings of your case, you need to have an open and direct communication with your spouse.
